The Federal Energy Regulatory Commission said it was right not to determine who owned newly built transmission facilities needed to get a new solar power generation facility connected to the interstate grid.
None of the companies involved in the squabble pointed to any agreement that supports their arguments for ownership, FERC said in a brief filed Tuesday with the US Court of Appeals for the D.C. Circuit.
Michigan Electric Transmission Co. argued in August that FERC was wrong to reject its bid for sole ownership of the new transmission facilities, also refereed to as network upgrades.
